Transactional Real Estate

The buying and selling of residential and/or commercial real estate. Our services include: reviewing the contract, inspection reports, mortgage documents, title search, attending to all closing and post closing services to ensure the client obtains legal title to the property purchased, or in the case of a seller, all liens are cleared to convey clear title to the purchase.

1031 Tax-Free Exchange

We represent real estate investors in handling 1031 exchanges. IRC Section 1031 (a)(1) allows an investor to sell a property, to reinvest the proceeds in a new property and to defer all capital gain taxes. This is a complex real estate transaction that rewards the investor with a deferral of capital gains on the sale of their real estate when they purchase new properties and wish to sell (exchange) old properties.

Estate Planning

The three documents necessary for proper estate planning are: a Will, a Living Will, and a Durable Power of Attorney. The person having these three documents would have a totally planned estate meaning, that almost all contingencies that would be faced in life and death are covered. There are varying degrees of formulating an estate plan depending upon the complexity and net worth of the client.

Wills

A Will is a legal document that directs how your assets are distributed to your beneficiaries after you pass away. It also requires that your taxes, debts and funeral expenses be paid prior to any distribution of funds to beneficiaries. A Will may be necessary to avoid a costly probate bond in the state of New Jersey.

Durable Powers of Attorney

A durable Power of Attorney insures that while you are alive that chosen individuals can stand in your shoes and make personal/business decisions for you.

Living Wills

A Living Will also called an Advance Health Care Directive directs health care professionals as to what your wishes are in the event you are disabled and medically unable to make health care decisions, for example a “do not resuscitate” directive would prohibit health care professionals from reviving you in the event you suffer a cardiac arrest.

Probate and Estate Administration

Upon a person’s death, the estate must be probated thereby appointing an executor or administrator as the case may be to carry out the terms of the will or statutory intestacy as may be required. Once the estate is probated, marshal estate assets, advise the executor/administrator to pay estate debts, taxes and distribute taxes to the beneficiaries.

Landlord Tenant

We provide services representing a landlord in negotiation, preparation and drafting leases in both residential and commercial settings. We further provide services to remove a tenant from the premises for various grounds including nonpayment of rent in both commercial and residential settings.

Debtor / Creditor Actions

We provide services representing business or individuals recovering moneys owed under contract for goods or services sold and delivered. Our services could also entail filing of a lawsuit to recover clients funds. We can also represent creditors and debtors in disputes and or settlements involving litigation and also have experience in filing bankruptcy for the client.

Municipal Tax Appeals

We provide legal services in representing property owners both residential and commercial in appealing their tax assessments at the county tax board and or in superior court as the case may be to lower the property tax assessment to fair market value.
